At St. Andrews the Seventeenth day of October Eighteen hundred and twenty three years in presence of Robert Low Esquire of Clatto Commissary of St. Andrews Compeared Mr. James Stark Writer in Cupar as procurator for John Cook after designed and gave in the Inventory Regd. Disposition and Settlement and Valuation under written desiring the same might be recorded in the said Commissary Court books in terms of the Act of Parliament which desire the said Commissary found reasonable and ordained the same to be done accordingly whereof the tenor follows;
Inventory of the Personal Estate of Mrs Jean Tullideph relict of John Tullideph Esquire of Kilmux, who dies at St. Andrews on the fourth day of November 1822.

signed by John Cook Charles Grace At St. Andrews the seventeenth day of October Eighteen hundred and Twenty three in presence of Charles Grace Commissary Clerk of St. Andrews Commissioner appointed for taking the following path:- Compeared Dr. John Cook Professor of Divinity in St. Marys College St. Andrews, who being so solemnly sworn and examined depones that Mrs Jean Tullideph relict of John Tullideph Esquire of Kilmux died at St. Andrews on the Fourth day of November Eighteen hundred and Twenty two and the deponent along with Henry David Hill Writer to the Signed designed in the Deposition and Settlement after mentioned Writer in Edinburgh entered upon possession and management of the said deceaseds personal Estate and Effects as Executors nominated by her along with the deceased Dr George Hill Principal of said St. Marys College in a Disposition and Settlement bearing date the Eleventh day of January Eighteen hundred and Seventeen with Codicils thereto annexed dated the Twenty Sixth day of March Eighteen hundred and Seventeen, Twenty Seventh September Eighteen hundred and Nineteen and Third May Eighteen hundred and Twenty and all recorded in the Books of Council and Session the Twelfth day of November Eighteen hundred and Twenty two an Extract of which is now exhibited and Signed by the Deponent and the said Commissioner as relative hereto, That the deponent does not know of any Settlement or Writing relative to the disposal of the deceaseds personal Estate or effects or any part of them, other than that now exhibited That the foregoing Inventory which is signed by the deponent and the said Commissioner as relative hereto is a full and complete Inventory of the personal Estate and effects of the said deceased wheresoever situated and belonging or due beneficially to the deceased at the time of her death in so far as the same has come to the deponents knowledge And that the value of said Estate situated in Scotland is of the value of Three hundred and under the value of Four hundred and fifty pounds sterling All which is truth as the deponent shall answer to God. Disposition and Settlement by Mrs Jean Tullideph
At Edinburgh the Twelfth day of November One Thousand eight hundred and Twenty two years in presence of the Lords of Council and Session Compeared Mr Thomas Thomson Advocate Procurator for Mrs Tullideph after designed and gave in the Disposition and Settlement under written to be registered in the Books of Council and Session conform to law which the said Lords ordained to be done accordingly whereof the tenor follows – I Mrs Jean Tullideph relict of John Tullideph Esquire of Kilmux in order to regulate the Succession to my moveable means and estate and having full confidence in the Trustees after named for executing the Trust hereby committed to them do by these presents Give Grant and Dispone to and in favour of Doctor George Hill Principal of St. Marys College St Andrews Doctor John Cook Professor of Divinity in said College and Henry David Hill Writer in Edinburgh and to the Survivors or Survivor of them All and Whole my moveable means and estate of whatever kind and denomination and all debts and sums of money that shall belong to me at the time of my death and in particular without prejudice to the foresaid generality my whole household furniture plate and plenishing of every description and Thereby empower my said Trustees to uplift and recover the whole debts and sums of money belonging to me hereby conveyed and generally to do everything in relation to the premises that I myself could have done before granting these presents And I do hereby nominate and appoint my said Trustees above named to be my sole Executors and intromitters with my whole moveable means and estate But in trust always and for the uses and purposes after mentioned Viz. In the first place that my said Trustees shall from the produce of my means and estate pay all my just and lawful debts and my funeral expenses Second ly I hereby appoint my said Trustees to deliver to Mrs Alison Tullideph or Thomson Sister of my late husband as a mark of my regard those six desert silver spoons and six teaspoons which I formerly received from her and also my set of castors an old family piece And in the event that the said Mrs Thomson predeceasing me I hereby declare that these pieces of plate shall be disposed of along with the rest of my property as aftermentioned Thirdly it is my wish and desire that the residue of my means and estate shall belong to the person or persons who shall be the most attentive to me in my old age and in my last illness And there fore I do hereby appoint my said Trustees to pay and make over the residue of my said means and estate to such person or persons as I shall point out by any writing under my hand And in the event of my failing to do so or to suggest to my said Trustees verbally to whom my said means and estate shall belong then I do hereby empower my said Trustees to exercise their own discretion and to pay and make over the residue of my said means and estate to such person or persons as they shall be satisfied were most kind and attentive to me in my old age and on my deathbed And I do hereby declare that my said Trustees shall not be liable for neglect or omissions of any kind: Reserving always to myself my own liferent of my whole means and estate of every kind with full power to me at any time in my life and even on deathbed to alter innovate or revoke these presents in whole or in part and to assign and dispose of the effects hereby conveyed in any manner I may think proper but in so far as these presents shall not be altered or revoked the same shall be valid and effectual although found lying in my own custody or in the custody of any other person for my behoof undelivered at the time of my death with the not delivery whereof I hereby dispense And I Consent to the registration hereof in the books of Council and Session or other Judges books competent therein to remain for preservation And for that purpose Constitute Mr Thomas Thomson Advocate my procurators In Witness whereof I have Subscribed these presents written upon Stamped paper by the said Henry David Hill At St. Andrews the Eleventh day of January Eighteen hundred and seventeen before these Witnesses William Foulis Wright in St. Andrews and Alexander Inglis Porter to St. Marys College / signed Jean Tullideph William Foulis Witness Alex Inglis Witness – I Mrs Tullideph within designed hereby make the following alterations on the written Settlement First I hereby declare that the Set of Castors within mentioned means only one Silver Sugar Castor – and Secondly – I hereby recall the within bequest of six silver tea spoons to Mrs Thomson In witness whereof these presents written on the back of my said Settlement by Henry David Hill within designed Are subscribed by me at St. Andrews the twenty Sixth day of March Eighteen hundred and seventeen before those Witnesses the within designed Alexander Inglis and John Bayne Servant to Principal Hill /signed Jean Tullideph Alex Inglis Witness John Bayne Witness I the foresaid Mrs Tullideph do hereby make the following addition to the within written Settlement I appoint my Trustees to pay to the person who shall be living with me at the time and shall attend me during my last illness the sum of one hundred pounds Sterling in Witness Whereof these presents written on the back of my said Settlement be the foresaid Henry David Hill are subscribed by me At St. Andrews the twenty Seventh day of September Eighteen hundred and Nineteen before these Witnesses the above designed Alexander Inglis and John Bayne /signed Jean Tullideph Alexr Inglis Witness John Bayne Witness – I the foresaid Mrs Tullideph do hereby make the following addition to the within written Settlement I appoint my Trustees to pay to Janet Cook daughter of the within designed Dr. John Cook one of my Trustees the sum of Fifty pounds Sterling as a mark of my good regard for her father and mother In Witness Whereof these presents written on the back of my said Settlement by the foresaid Henry David Hill are Subscribed by me at St. Andrews the third day of May Eighteen hundred and Twenty before these Witnesses Thomas Hill Student of Divinity there and the above designed Alexander Inglis /signed Jean Tullideph Thomas Hill Witness Alexr Inglis Witness Extracted furth of the records of the Court of Session upon this and the Seven preceding pages of Stamped paper by me Thomas Peat Writer to the Signed Principal Keeper of the said Records / signed / Tho: Peat St. Andrews 17 October 1823 This is the Ext.
